MESSAGE OF Xth FEDERAL COUNCIL

Xth Federal Council of National Federation of Postal Employees was held at Guwahati (Assam) from 7th September to 9th September, 2016. A galaxy of Trade Union leaders admired the struggling nature of NFPE moving on the path with a slogan “Unity for struggle and struggle for unity”. The Federal Council reviewed the Political, economical and social condition of India and its impact on working class. It was discussed in detail that during the period under review, higher administration of the Department of Posts and Government of India tried to make some structural changes in the Department of Post which was fought by NFPE and defeated and NFPE established its might. There is significant change in the mindset of Bureaucracy and our membership has gained faith a lot in union which has been reflected in last membership verification.

            The Federal Council reviews the recommendations of 7th CPC and it was the view of most of the delegates that the recommendations of 7th CPC are most retrograde and disappointing. More anomalies are appearing in implementation of the 7th CPC. The Committees formed  on allowances, advances, NPS and  so called High Power committee to review the minimum wage  and consequently change in pay  matrix , have to submit their reports within 4 months i.e. upto 31st  Oct, 2016.

            It was the view of most of the delegates that NJCA should take proper action to achieve the demands and without breaking the unity, Confederation and NFPE should also chalk out their separate programme of action in phased manner.

            It was also discussed and decided that we as NFPE should also launch agitational programmes in phased manner to achieve our sectional demands i.e. Cadre restructuring  for left out Categories, Filling up of vacant posts, enhancement of ceiling of bonus to GDS . GDS Committee,streaming the functioning of NCJCM, DCJCM and RJCM. Regularization and wage revision of casual labourers, All Cadre related problems, problems arising out of implementation of CBS and CSI and to oppose the move to outsource any function of Postal services.

            Policy and programmes resolution was also adopted in the Federal Council unanimously in which it is decided that the NFPE being in the main stream of working class will fight against the neo-liberal economic policies which are adversely affecting the life of all working people and common man.

            This Federal Council viewed with grave concern the growing right Wing offensives under NDA Government and aggressive activities of the communal forces and deliberate efforts to divide the people including workers on the basis caste and religion and took unanimous decision to defeat such move by organizing united struggles and shall stand finally with the secular and democratic forces.

            Thus the Xth Federal Council has given a very common  message to the Postal workers  particularly and common worker in general  that NFPE will march forward on the path of struggle to save the interests of workers and achieve the  genuine and justified  demands by united struggle.

            The Xth Federal Council has also adopted a resolution on common and specific demands of Postal Employees and decided further course of agitaional programmes in phased manner



            NFPE calls upon the entire Postal, RMS, and MMS employees to get ready for future struggles to achieve the genuine demands and resists the attacks and dangers unlashed by the Department of Post and Government of India which are against the Postal Workers.

7th Pay Commission: Achhe Din for government employees, Centre likely to hike Dearness Allowance by 2 per cent before Dussehra

Union Finance Minister Arun Jaitley will move the proposal of hike in DA on the basis of accepted formula for calculation under the 7th Pay Commission recommendation.

In a good news for 10 million central government employees, Narendra Modi government is likely to hike dearness allowance (DA) by 2 per cent ahead of the Dusshera festival. Union Finance Minister Arun Jaitley will move the proposal of hike in DA on the basis of accepted formula for calculation under the 7th Pay Commission recommendation, while the Union Cabinet is expected to clear the proposal of hike in DA in the next meeting. The 7th Pay Commission recommended the merging of 125 percent dearness allowance into the basic pay.

The Central government is likely to hike dearness allowance (DA) by 2 per cent, based on the data of the Consumer Price Index- Industrial Workers ( CPI-IW). Average rate of Consumer Price Index-Industrial Labour from July 2015 to June, 2016 was 2.90 per cent. Thus, the Centre will increase dearness allowance by two as per accepted formula for calculation, a Finance Ministry official working on the implementation of the 7th Pay Commission recommendations was quoted as saying by the Sen Times.

Unlike the 6th Pay commission, which had recommended the basic pay based on the Consumer Price Index 115.76 in January 2006, 7th Pay commission recommended new pay matrix, based on the Consumer Price Index 261.42. The government will use the data of CPI-IW from July 1, 2015 to June 30, 2016. The CPI (IW) of the months July, August, September, October, November, December, January, February, March, April, May and June were 263, 264, 266, 269, 270, 269, 269, 267, 268, 271, 275 and 277 respectively.

The Centre revised DA twice in a year on the basis of one year average of retail inflation for industrial workers as per the accepted formula. Last times, the government had increased DA by 6 percentage points from 119 to 125. The new rate of DA will be implemented from July 1, 2016. The cabinet approved the 7th Pay Commission’s recommendations for central government employees on July 29, which will impact some 47 lakh central government employees and 53 lakh pensioners.

The 7th Pay Commission notification confirmed that central government employees will get 14.27 per cent hike in basic pay at junior levels, which is the lowest in 70 years. The Cabinet also approved the increase in minimum pay Rs 18,000 from existing Rs 7,000. The 7th pay commission had recommended abolition of 51 allowances and subsuming 37 others out of 196 allowances. However no final decision has been taken on the allowances by the government. The allowances had been a major bone of contention amongst majority of the central government employees.

Grant of enhanced bonus to GDS and payment of revised wages of casual labourers

    Regarding grant of enhanced bonus of 7000 to GDS, Com. R. N. Parashar, Secretary General, NFPE discussed with Chairman, GDS Committee, Shri Kamalesh Chandra today (29.09.2016). Chairman informed that he had recommended for payment of bonus to GDS at the enhanced calculation ceiling of Rs. 7000/- and the file returned to Postal Board. (Last time Nataraja Murthy Committee has recommended that GDS should not be paid enhanced bonus and their bonus should be reduced to 50% of the departmental employees). Now that, GDS committee has recommended 7000, Postal JCA has demanded Postal Board to issue bonus orders of GDS with calculation ceiling of 7000/- without any further delay.

NFPE FEDERAL SECRETARIAT MEETING

The Federal Secretariat meeting of NFPE was held at New Delhi on 27.09.2016 under the presidentship of Com. Giriraj Singh, President, NFPE. Representatives of all affiliated organisations attended the meeting. Com. M. Krishnan, Ex-Secretary General & Secretary General, Confederation also attended and guided the iscussion and decisions. Com. R. N. Parashar, Secretary General, NFPE reported the non-grant of enhanced bonus to GDS and the efforts made by NFPE leadership to settle the issue. He also reported the non-settlement of payment of arrears to casual Labourers inspite of orders issued by Directorate. Com. Parashar, reported the details discussion he had with Shri. D. Theagarajan, Secretary General FNPO and placed the following proposal of PJCA before the Secretariat meeting.

1.      Phase programme of action culminating in two days nation wide strike on 9th & 10th November 2016 exclusively on the bonus demand of GDS and revision of wages of casual labourers.

2.      The Secretariat after detailed discussion decided to implement the decision of PJCA. Accordingly the Federatl Secretariat calls upon all Branch/Divisional/Circle Secretaries of NFPE affiliated Unions/Associations and also AIPEU-GDS to make the agitational programmes and two days strike cent percent success. HOMAGE TO COM. DES RAJ SHARMA
Before commencement of the meeting, the National Secretariat paid respectful homage to Late Com. Des Raj Sharma, Ex-General Secretary, P-IV CHQ & Ex-Deputy Secretary General, NFPE. The Secretary General and all other participants mentioned about the unforgettable contributions made by Com. Des Raj Sharma and also his sufferings for strengthening P-4 Union, NFPE and Confederation. The National Secretariat expressed it heart-felt condolences and offered two minutes silence.

DEPARTMENTAL ANOMALY COMMITTEE – DEPARTMENT OF POSTS

Secretary General reported the communication received from the Department regarding constituition of Departmental Anomaly Committee. The following will represent NFPE in the Committee against the 5 seats allotted to NFPE. Com. R. N. Parashar (SG & GS – P3), Com. Giriraj Singh (GS-R3) Com. R. Seethalakshmi (GS-P4), Com. P. Suresh (GS-R4) Com. Pranab Bhattacharjee (Admin Union).

It is decided that all General Secretaries should submit the items to be included in the agenda of the Anomaly Committee to Com. Giriraj Singh, Secretary, JCM (DC) staff side on or before 15.10.2016. Branch/Divisional/Circle Secretaries should submit the items to their respective General Secretaries before 12.10.2016.

FINAL MEETING WITH CHAIRMAN GDS COMMITTEE

Chairman GDS committee has invited NFPE for final interaction before finalizing the recommendations. Accordingly, Com. R. N. Parashar, Secretary General, NFPE and Com. P. Panduranga Rao, General Secretary, AIPEU-GDS, shall attend the meeting on 7th October 2016.

Minimum wage and fitment formula for Central Government Employees

Comrade,

                 The 7th CPC while calculating the minimum wage of Central Government Employees has arrived at Rs 18,000/- the 7th CPC has erred in prescribing  provision to cover education, recreation, ceremonies, festivals and medical expenses has been moderated to 15 percent  against the provision of 25% . Supreme Court’s ruling in the Raptakos Brett Vs Workmen case of 1991 , the Hon’ble Supreme Court delivered a historic judgement and directed that children’s education, medical requirement, minimum recreation including festivals/ceremonies, provision for old age, marriage etc. should further constitute 25% of the minimum wage and be used as a guide in fixation of minimum wage.
      The Hon’ble Minister of Labour & Employment Shri Bandaru Dattatreyaji in his press statement on 24-September-2016  has stated in Understanding Minimum Wages and Bonus article as follows.
“The norms recommended by the Indian Labour Conference, in 1957, fox fixing the minimum wages are: (a) consumption units for one wage earner; (b) minimum food requirements of 2700 calories per average Indian adult; (c) clothing requirements of 72 yards per annum per family; (d) rent corresponding to the minimum area provided for under Government’s Industrial Housing Scheme; and (e) fuel, lighting and other miscellaneous items of expenditure to constitute 20% of the total minimum wage.
In 1991, the Hon’ble Supreme Court delivered a historic judgement and directed that children’s education, medical requirement, minimum recreation including festivals/ceremonies, provision for old age, marriage etc. should further constitute 25% of the minimum wage and be used as a guide in fixation of minimum wage.”
  If this provision is alone adopted should have been adopted by the 7th CPC, the minimum wage would have increased by more than 10% and worked out to Rs 20,000/-. The fitment formula will work out to 2.86. If the entire minimum wage is recalculated based on actual retail prices as on July 2015 without applying average of 12 months  and correct methodology the minimum  wage would be Rs 26,000/ and fitment formula would be around 3.5 .
The minister statement should be applied by the Government in true spirits and the minimum wage and fitment formula should be enhanced accordingly.

Cabinet approves Productivity Linked Bonus ( 78 Days) to Railway Employees

The Union Cabinet chaired by the Prime Minister Shri Narendra Modi, has given its approval to pay Productivity Linked Bonus (PLB) equivalent to 78 days wages to eligible non-gazetted railway employees (excluding RPF/RPSF personnel) for the financial year 2015-16. The approval entails a financial implication of approximately Rs.2090.96 crore.
Payment of PLB would result in motivating a large number of railway employees to improve the performance of the Railways and enhance the productivity levels further besides maintaining industrial peace.

The payment of this Bonus to eligible Railway Employees will be made before Dussehra/Puja holidays.

7th Pay Commission: Fatter Allowances Report May Be Delayed By A Week

New Delhi: The submission of report on fatter allowances is likely to be delayed by a week, primarily because Uri terror attack on an army base in Jammu and Kashmir and partly BJP national executive meet held in the Kerala city of Kozhikode.

However, Congress criticised BJP’s Kozhikode event after the September 18 terror attack at Uri.
“The report of the committee on allowances, headed by Finance Secretary Ashok Lavasa was to submit last week but the Finance Minister Arun Jaitley was too busy with political agenda for the both incidents that so fatter allowances was not prioritised,” sources in Finance Ministry familiar with the matter said today morning asking not be named.
“The committee on allowances is ready to submit its report even two months in advance, when the Finance minister calls up, the committee will submit its report.
The committee is likely to call on Finance Minister Arun Jaitley in this week, if the political situation returns to normal,” sources added.
The 7th pay commission had recommended abolition of 51 allowances and subsuming 37 others out of 196 allowances, recommendation is radical in nature and the central government employees’ unions did not want to approve the 7th Pay Commission recommendations on allowances without examining them further.
Accordingly, the government has decided that the recommendations on allowances, other than dearness allowance, will be examined by a committee on allowances, when the Union Cabinet cleared the recommendations of 7th Pay Commission in respect of the hike in basic pay and pension on June 29.
The committee on allowances, already met with employees unions leaders on August 4 and September 1 respectively and the committee prepared its report, the central government employees’ unions leaders said.
The matters relating to pay and pension as decided by the government have been implemented with effect from January one this year.
However, the pay commission resolution issued on July 25 said, “till a final decision on allowances is taken based on the recommendations of this Committee, all allowances will continue to be paid at existing rates in existing pay structure, as if the pay had not been revised with effect from January 1, 2016

37. Regarding counting of the period of induction training for benefit of promotion under the TBOP/BCR Schemes :- The issue regarding counting of the period of induction training spent by the employees of this Department for the benefit of promotion under the TBOP/BCR schemes has been under consideration of this office for some time. After consultation with the Department of Personnel and Training, it has now been decided that the period of induction training may also be counted for the benefit of promotion under the above schemes. However, past cases decided otherwise would not be covered by the above orders. This issue with the concurrence of Integrated Finance Advice vide their Diary No. 378/FA/2000 dated 25.7.2000.

Counting of the period of induction training for benefit of promotion under the TBOP/BCR schemes-clarifications:-(1) I am directed to refer to this Department's letter of even number dated 3.8.2000 [Para 37] on the above subject. References have been received from many Circles seeking clarifications on the above orders. The matter has been examined in detail in consultation with the Integrated Finance Wing of this Department and the position is clarified as under.

(2) This issues with the concurrence of Integrated Finance Wing vide their Diary No. 320/FA/2001 dated 17.7.2001.

(1) What will be the date of effect of the above order,
The cases decided prior to 3.8.2000 would not be covered by the order dated 3.8.2000. 
(2) Whether the departmental candidates will also get the benefit of counting of induction training period prior to their promotion as Time scale clerks for the  benefit of promotion under  benefit of promotion under  TBOP/BCR ?                                                                                           
DO P&T has clarified that since the period of induction training is counted for the purpose of increments and qualifying       service for departmental examination, it would also count for the purpose of promotion under the TBOP/BCR schemes.
Therefore, it is clarified that the period of induction training in respect of departmental candidates would also count for the purpose of promotions under TBOP/BCR schemes provided that such training period is obligatory for the departmental candidates in respect of the cadre to which they are to be promoted and they are to be promoted immediately on completion of such induction training period and also such         training period is counted for increment in the promoted cadre.
(3) If the junior officials get               promoted earlier than the   seniors as per the orders   dated 3.8.2000, whether the   seniors can claim benefit of       promotion under the above scheme from the date of promotion of the junior officials? 
                                                      
As per letter No. 22-6/2000-PE.I dated 17.5.2000, officials would be promoted under the TBOP/BCR schemes only after completion of qualifying service. Therefore, the question of senior claiming benefit with reference to the juniors etc. does not arise.
